YUM Baby Terms of Service

Last updated: 9 October 2026

1. About these terms

These Terms of Service apply to purchases from yumbaby.co.za and your use of the YUM Baby online store. In these terms, “YUM Baby”, “we”, “us” and “our” refer to Kirsty Jane Tramontino, a sole proprietor trading as Yum Baby. “You” refers to the customer or website user.

We sell frozen baby and toddler food for delivery within South Africa. Our online store is hosted on Shopify. Payments are processed through PayFast, and deliveries are arranged through MyCourier.

Read these terms together with our Shipping Policy, Refund Policy and Privacy Policy. You can save or print these terms for your records.

These terms do not remove or restrict any rights you have under applicable South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. If a term or linked policy conflicts with a mandatory legal right, that right applies.

2. Who may place an order

The store is intended for adults purchasing food for children. You must be at least 18 years old, or place an order with the assistance and consent of a parent or guardian who is authorised to enter into the transaction.

You must provide accurate contact, billing and delivery details. If you notice a mistake after ordering, contact us promptly. We will explain whether it can still be corrected before dispatch.

If you create an account, keep your login details secure and notify us if you suspect unauthorised access.

3. Product information and suitability

Product pages and packaging provide information about the products, including ingredients, portion sizes and preparation or storage instructions where applicable. Please read this information before purchasing and before serving the food.

Photographs illustrate our products. Natural differences in ingredients and preparation may affect appearance, colour and texture. These differences do not excuse a product that fails to match its description or meet applicable quality and safety requirements.

Age guidance is general guidance. A child's readiness for a food or texture depends on their development and individual needs. Website content does not replace advice from a qualified healthcare professional.

Do not assume a product is free from an allergen because it is not mentioned in promotional wording. Check the ingredients and allergen information for the specific product. If information is missing or unclear, contact us before ordering or serving the food. Where your child has an allergy, intolerance or medical dietary requirement, seek appropriate professional advice about suitability.

These customer precautions do not reduce our obligations to provide accurate product information, legally required labelling and safe products.

4. Prices and payment

Prices are shown in South African rand. The amount payable, including delivery charges and any applicable taxes or other charges, must be displayed before you complete your purchase.

Payments are processed through PayFast using the payment methods offered at checkout. Do not send card details or payment credentials to us by email or WhatsApp.

We may change prices for future purchases. A later price change does not change the price of an order already accepted.

If we discover a pricing or listing error affecting your order, we will contact you to explain it. Any correction, cancellation or refund will be handled in accordance with applicable law. We will not increase an accepted order's price without your agreement.

5. Orders and availability

Before paying, review your products, quantities, delivery address, contact details and total price. You can correct errors or leave checkout before submitting your order.

We send order communications to the email address you provide at checkout. Keep these communications and your payment confirmation as records of your purchase. If there is a stock, payment or delivery issue affecting your order, we will contact you.

We may be unable to fulfil an order because of unavailable stock, an address outside our delivery area, a failed payment or reasonable concerns about fraud. Any refusal or cancellation remains subject to applicable law and any contract already formed. We will explain the issue and refund payment received for products we cannot supply. We will not substitute a different product without your agreement.

After acceptance, any cancellation by us remains subject to your contractual and statutory rights. Keep your order emails and payment confirmation. Contact us if you need a copy of your order record.

6. Delivery

Delivery is available to the South African areas supported at checkout. Delivery charges are shown before payment.

Our standard delivery estimate is 3–5 working days, unless a different timeframe is clearly stated before ordering or agreed with you. Working days exclude Saturdays, Sundays and South African public holidays.

If a significant delay occurs, we will contact you about the revised timeframe and available options. This estimate does not remove any right you have to cancel or obtain a refund where delivery is not completed as agreed or required by law.

Provide an address where you or a person you authorise can receive frozen food. If delivery cannot be completed because of incorrect details or the recipient being unavailable, we will contact you to discuss the next steps. Any additional delivery charge must be reasonable, explained and agreed before a further delivery is arranged.

We remain your contact for delivery complaints even when a courier delivers your order. Using a courier does not remove our obligations to you. Risk in the goods remains with us until delivery is completed in accordance with applicable law.

7. Receiving and handling frozen food

Check your order when it arrives. If packaging is damaged, items are missing or incorrect, or you are concerned that food has thawed or become unsafe, contact us as soon as reasonably possible. Provide your order number, a description and photographs if available.

Prompt reporting helps us investigate food condition and delivery problems. It is not a fixed deadline that removes your statutory rights.

Do not serve food if you suspect it is unsafe. Contact us for instructions about the affected product rather than sending it back through an ordinary courier.

Follow the storage, defrosting, heating and use-by instructions on the product packaging. Store the food promptly and appropriately after receipt. We will assess complaints fairly, taking account of the condition on arrival, the product instructions and subsequent handling.

8. Cancellations, returns and refunds

Contact us promptly if you want to change or cancel an order. We will explain what is possible based on its stage of preparation and dispatch, our Refund Policy and your legal rights. We will not impose a cancellation charge unless it is lawful and reasonable.

The ordinary seven-day cooling-off right under section 44 of the Electronic Communications and Transactions Act does not apply to transactions excluded by section 42, including qualifying food deliveries and goods likely to deteriorate or expire rapidly. This does not create a blanket “no refunds” rule or remove other cancellation or consumer rights that apply to your purchase.

If a product is unsafe, defective, incorrect or does not meet applicable quality requirements, contact us. We will provide the remedy required by law, which may include a replacement or refund. You are not required to accept store credit instead of a monetary refund where the law entitles you to a refund.

Further practical arrangements are set out in our Refund Policy. That policy must be read subject to your statutory rights.

9. Promotions

Each promotion may have specific dates, eligibility requirements, qualifying products or redemption limits. These conditions will be stated with the offer or before checkout.

A promotion does not change your rights regarding product quality, safety or lawful refunds. We will not retrospectively change the conditions of a promotion for an order already accepted under it.

10. Reviews and feedback

Reviews must reflect genuine experiences and must not contain unlawful material, confidential information or personal information about others without permission.

If you submit a review expressly for publication on our store, you authorise us to display that review with the name you choose for publication. We may remove unlawful content or personal information that should not be published, but will not change the meaning of your feedback.

Sending a private email, WhatsApp message or complaint does not give us unrestricted permission to publish it. We will seek permission before republishing private testimonials or identifiable photographs, including photographs of children.

11. Website content and acceptable use

Our branding, original photographs and other original website content belong to YUM Baby or the relevant rights holders. You may browse, share links and save information for personal shopping purposes. Commercial reproduction requires permission unless otherwise permitted by law.

Do not use the website for fraud, impersonation, harassment or unlawful activity. Do not introduce malicious code, access accounts without permission or interfere with checkout or website security.

We may restrict access where reasonably necessary to address misuse or protect the store. This does not cancel your rights relating to existing orders, refunds or complaints.

12. Privacy and communications

Our Privacy Policy explains how we handle personal information, including order details, enquiries and information processed through analytics and advertising tools.

Our store is hosted by Shopify, which processes personal information when you visit or purchase from the store. Shopify Network Intelligence is enabled. Shopify uses information about interactions with our store, other merchants and Shopify to provide services, including enhanced features that protect, improve and support our business and other Shopify businesses. Information is shared with Shopify and other service providers that may be located outside South Africa. Our Privacy Policy explains this processing and your choices. You can also read Shopify’s Consumer Privacy Policy and visit Shopify’s privacy portal.

We may contact you about your order, delivery, payment or support request. Promotional communications are handled separately in accordance with applicable law and your marketing choices. Accepting these terms or making a purchase does not, by itself, amount to consent to every form of marketing.

13. Website availability and third-party services

The website may occasionally be unavailable because of maintenance, technical problems or events beyond our reasonable control. Contact us if an interruption affects your order or payment.

External websites and services have their own terms and privacy practices. Links to them do not remove our responsibilities for the products we sell or the services we arrange as part of your purchase.

14. Responsibility and consumer protection

We remain responsible for our obligations under applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for unsafe or defective products, fraud or gross negligence.

Customers retain the legal remedies available to them for injury, food safety issues, delivery failures and inaccurate product descriptions. Responsibility is determined by the circumstances and applicable law.

15. Complaints and disputes

Contact us using the details below and provide your order number and a description of the issue. We will investigate and work with you to resolve the complaint.

You may also approach the Consumer Goods and Services Ombud at cgso.org.za, the National Consumer Commission at thencc.org.za, or another body or court with jurisdiction, as applicable. Contacting us first does not remove a legal right to seek other redress.

These terms are governed by South African law. They do not require you to give up access to an appropriate tribunal, regulator or court.

16. Changes to these terms

We may update these terms for future purchases and website use. We will publish the revised version with its effective date and give further notice where required by law.

The version in force when your order is accepted applies to that order, unless a change is required by law or expressly agreed with you. Later updates do not retrospectively reduce your rights.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms do not override a specific written agreement about your order or a binding representation protected by consumer law.
